<p>If you&#8217;ve spent any time on Facebook, then you&#8217;ve probably already seen too many bad social marketing offenses to count&#8230; I know I have!</p>
<p>So here are what I consider to be the top 3 most stupid Facebook marketing mistakes:<span id="more-1448"></span></p>
<h2>1.  Saying too much in your friend request.</h2>
<p>I have several different accounts on Facebook and it always amazes me how many people do &#8220;in your face&#8221; marketing when they send you a friend request.  Let me explain&#8230;</p>
<p>When you click on the &#8220;add as a friend&#8221; box, you have the option of including a personal message.</p>
<p>Most people don&#8217;t bother with including a personal message, then just send the request.  Others will write some kind of reference so that you know why they are requesting you (we&#8217;re in the same group, I like your blog, we have similar interests, etc.).</p>
<p>However, about 5% of my friend requests will send me something like this:</p>

<p>Of course not!</p>
<p>Facebook is about networking with people who are interested in you and the things that you write about.  It&#8217;s about b<span style="text-decoration: underline;"><em>uilding rapport and establishing a relationship.</em></span></p>
<p>When you ask someone to connect with you on Facebook, it&#8217;s kind of like introducing yourself at a party.  You don&#8217;t walk up to someone, shake their hand, and then immediately try to recruit them into your business or sell them your product.</p>
<p>You shouldn&#8217;t do that on Facebook either.</p>
<h2>2.  Using a promotional image in profile.</h2>

<p>They are just opportunists.<em><strong><br />
</strong></em></p>
<p>In my experience, these types of people send tons of junk email, spam my wall, and bother me ceaselessly without any type of meaningful interaction.<a href="http://www.arvadayates.com/wp-content/uploads/2010/05/n97260093846_9954.jpg"><img class="alignright size-thumbnail wp-image-1462" title="n97260093846_9954" src="http://www.arvadayates.com/wp-content/uploads/2010/05/n97260093846_9954-150x150.jpg" alt="" width="90" height="90" /></a></p>
<p>From a business perspective, it makes no sense for me to try to connect with people like that&#8230; <em><strong>it&#8217;s a waste of my time if I&#8217;m not connecting with real people.</strong></em></p>
<h2>3.  Spamming other people&#8217;s walls.</h2>
<p>This is a HUGE pet peeve of mine.  I absolutely hate it when people spam my wall with advertising for their opportunity, business, or product.</p>
<p><em><strong>It&#8217;s my wall. </strong></em></p>
<p>If you want to talk to me, then I would love for you to leave a comment, but my wall doesn&#8217;t exist to be a billboard for your advertising!</p>
<p>And the same goes for fanpages and group pages&#8230; NO SPAM!</p>
<p>As a matter of course, I usually &#8220;un-friend&#8221; people who spam me and delete their posts.  I just don&#8217;t want to deal with people like that.</p>

<p>I wanted to develop a new website for my <a href="http://arvadayates.com/nuskin">Nu Skin</a> products (an MLM company that I recently got involved with).  I wanted to create a blog where I could review products and provide content.</p>
<p>So, my first stop was to decide on a domain name.<span id="more-1377"></span></p>
<p>I knew that I couldn&#8217;t use any domain with the term &#8220;Nu Skin&#8221; in it because it was a <em><strong>trademark infringement</strong></em>.  That&#8217;s one of those things that I&#8217;m always careful about.  So after looking at all the domain names available I settled on Elite-Skin-Care.com.</p>
<p>The domain fit the image that I was looking for, it was fairly short, and it was available.</p>
<p><em><strong>Whoohoo!</strong></em></p>
<p>I bought the domain and immediately set out on creating a blog complete with a logo that incorporated the domain name, several keyword rich blog posts, free ecourse, reviews, etc.</p>
<p>It was a pretty nice looking blog&#8230;<em> if I do say so myself!</em></p>
<p>And things were going pretty well with it.  Some of the content had started getting indexed, I started getting subscribers, and <span style="text-decoration: underline;">traffic was on the rise</span> &#8212; everything you want to happen with a new blog.  <em><strong>I was quite pleased with myself.</strong></em></p>
<p>Then I got this notice in my inbox:</p>
<blockquote><p>Re:  ELITE SKIN CARE  &#8211; TRADEMARK INFRINGEMENT</p>
<p>Dear Ms. Yates:</p>
<p>Elite Skin Care, LLC is the owner of the registered trademark ELITE SKIN CARE® (the “ELITE Trademark”) for use in connection with skin care products and services.  We have used the ELITE Trademark since 1993, and the mark has been registered with the U.S. Patent and Trademark Office since 2004 (U.S. Trademark Registration No. 2821236).  By virtue of our long use of, and investment in, the ELITE Trademark in promotion and operation of our business, the ELITE Trademark has come to be a well-recognized and valuable asset of Elite Skin Care, LLC.</p>
<p>It has come to our attention that you are using the trade name/trademark “Elite Skin Care&#8221;  in association with the marketing, sale, distribution or identification of skin care products.  Elite Skin Care values its ELITE SKIN CARE trademark very highly and takes this unauthorized use of it very seriously.</p>
<p>We assume that your unauthorized use of a mark identical to the ELITE Trademark is without intent or desire to confuse the public, nor is it your intention to trade upon Elite Skin Care&#8217;s goodwill associated with its ELITE Trademark.  However, your use of the identical mark in connection with your business of marketing or selling skin care services/products is confusing and may mislead customers and potential customers into believing that your skin care products/and or services originate from, or are associated with those of Elite Skin Care, LLC.  This confusion may cause material and irreparable harm to the ELITE Trademark by eroding the distinct association among our Trademark, our products and services, and our company.</p>
<p>As such, your use of Elite Skin Care constitutes an unfair business practice as well as trademark infringement under the federal Lanham Act, 15 U.S.C. Sec. 1051 et. seq..  These actions may subject you to payment of actual and treble damages, recovery of profits, reimbursement of attorney’s fees and may also include injunctions against your further use of your infringing mark.</p>
<p>Accordingly, we request that you immediately cease any and all further use of the Elite Skin Care trademark, as well as any other marks confusingly similar to Elite Skin Care, including, but not limited to changing your business or trade name; terminating your use of the website address www.elite-skin-care.com and any other web address containing the term Elite Skin Care ; and removal of the term Elite Skin Care from any and all advertising, marketing and promotional materials and website informational materials used in connection with your sin care services or products. .</p>
<p>Please confirm within 10 days of the date of this letter that you will comply with the terms of this request.  This letter is without prejudice to the assertion of any and all legal remedies that we may pursue as necessary to protect our rights.</p>

<p>It would be fair to say that <em><strong>I was a bit ticked off&#8230;</strong></em> but then I thought about it.</p>
<p><span style="text-decoration: underline;">This was totally my own fault.</span> I was so wrapped up in the idea that I couldn&#8217;t infringe upon the Nu Skin trademark that I didn&#8217;t even check to see if there were any other trademarks against the domains that I was looking at.</p>
<p><strong>REALLY stupid mistake&#8230; a mistake that I&#8217;ve never made before.</strong></p>
<p>So&#8230; <span style="text-decoration: underline;">I completely removed the site</span> &#8212; what else could I do?</p>
<p>It means a couple of weeks worth of work wasted and a little bit of money down the drain.  I hate that, but I still have a lot of content that I can use elsewhere.</p>
<p><strong><em>It could have been A LOT worse.</em></strong></p>
<p>Plus it was a really valuable lesson to make sure that I don&#8217;t get ahead of myself next time and do my homework before I buy the next domain.  <em><strong>I&#8217;ve been in business a long time &#8212; I knew better.</strong></em></p>
<p>Hopefully sharing this story will keep you out of hot water.  <strong><span style="text-decoration: underline;">Research your domain name before you buy it</span></strong> to make sure someone else doesn&#8217;t already own the trademark.

<p>As you know, I wrote the original post on March 24th at around 3p.m.  <strong>By 8p.m. the same day</strong>, this message was posted to my blog:<span id="more-1357"></span></p>
<blockquote><p>Hi Ms. Yates,</p>
<p>Wow, did this ever get mixed up. Let me clear up a few misunderstandings. Article Marketer didn&#8217;t cease operations, it split into two companies, DistributeYourArticles.com and ContentCrooner.com. The customer list was split randomly. Your account was assigned to DistributeYourArticles.com. Each company continued to honor the subscriptions of its assigned customers.</p>
<p>Alas in your situation, when you contacted PayPal, ContentCrooner&#8217;s customer service responded to you about your refund request even though it should have been DistributeYourArticles that responded. The transaction that you asked to be refunded was from January of 2009, long before the split. You have noted here that you had some transactions from February of 2010. You should by all means talk to DistributeYourArticles about those transactions.</p>

<p>Obviously if the dispute was sent to Content Crooner via paypal, then they were the ones that ran the old subscription and charged my account&#8230; the other company (distributeyourarticles) didn&#8217;t own that subscription, article marketer owned it.  If article marketer now owns content crooner, then your company is the one that owns that subscription and charged the account.</p>
<p>When I joined distributeyourarticles, I had to sign up for a completely new subscription &#8212; there was no carryover from article marketer &#8212; the subscription didn&#8217;t move over.</p>
<p>Please explain how you believe that distributeyourarticles charged my account when all the information I have from Paypal points to you guys.</p>

<p>However,  I don&#8217;t want you to have to suffer through anymore rigmarole with my former business partner, so I have copied him on this note. <p>Article Marketer is an article distribution service that I used to use last year.  I was pretty happy with the service, but they discontinued their service last October and split into two different services:  ContentCrooner.com and DistributeYourArticles.com</p>
<p>Now I use DistributeYourArticles.com&#8230; the service is pretty okay, and I pay a separate monthly fee for it.</p>
<h2>So here&#8217;s the rub on how they ripped me off&#8230;</h2>

After Article Marketer discontinued their service in October, they turned around and <strong>charged me their yearly fees on two different accounts on February 28, 2010.  Total amount charged was about $130.</strong></p>
<p>Thinking this must surely be an honest mistake, I contacted Article Marketer through Paypal&#8217;s dispute resolution process.  Here is the entire transcript of what was said:</p>

His renewal date was 2/28 on each following year as he continued to pay for annual subscriptions up until 2009. When the buyer signed up, he agreed to Article Marketer&#8217;s Terms of Agreement that his billings would be handled on a recurring billing basis. The below paragraph is just one paragraph that refers to the recurring billing: &#8220;Recurring subscriptions automatically renew on the billing date until canceled through your PayPal account. If you would like to cancel your Article Marketer subscription, login to your PayPal account. You will find complete instructions in the PayPal help system. Type &#8220;How do I cancel my subscription?&#8221; into the PayPal help system search box. You may cancel your subscription through your PayPal account at any time without refund.&#8221; Since the beginning of October when Article Marketer split, the decision they made was to split the company into two companies, Content Crooner and Distribute Your Articles. The buyer&#8217;s account was transferred to Content Crooner at that time and was notified via email on November 2, 2009.</li>

<p>After these defunct subscriptions were initially charged, I went back into my paypal history and found that there were two subscriptions still active for Article Marketer&#8230; <em><strong>I assumed that when they dissolved their service that they would cancel subscriptions on their end.</strong></em></p>
<p>Apparently I was wrong&#8230; so I went in and canceled these year old subscriptions.</p>
<p>That doesn&#8217;t change the fact that<strong> Article Marketer charged me for a service that they no longer offer on a subscription that should have been invalid and <span style="text-decoration: underline;">then refused to refund my money</span>.</strong></p>
<h2>PayPal&#8217;s Response</h2>
<p>No joy &#8212; <span style="color: #ff0000;"><em><strong>They&#8217;re letting Article Marketer keep my money!</strong></em></span></p>

<h2>What Can You Do To Protect Yourself?</h2>
<p>I personally think this is <strong>completely ridiculous and unscrupulous on the part of ArticleMarketer.com</strong> and I think <span style="text-decoration: underline;">Paypal has a very bad policy about intangible services</span>.  In this case, the service was never delivered and the company had no intention of delivering the service&#8230; <em><strong>seems pretty cut and dry to me.</strong></em></p>
<p>So how can you protect yourself against a situation like this?</p>
<ol>
<li>Don&#8217;t do business with ArticleMarketer.com in ANY way.  They&#8217;ve proven themselves to be unscrupulous.</li>
<li>Don&#8217;t use PayPal to pay for ANY intangible service&#8230; That includes ebooks, virtual services, and anything delivered digitally.  Us a credit card instead.</li>
<li>Keep a close watch on your current subscriptions.  If a subscription service stops offering the service, be sure to go into your account and cancel the subscription yourself.</li>
</ol>
<p>Hopefully this ridiculous situation will help someone else avoid getting taken advantage of too.  If you happen to have any latent subscriptions to Article Marketer, be sure to find them and cancel them immediately!

<p>This time I started a completely new account, new email, different credit card, different computer… even a different IP to set up the account because I wanted to be able to start from scratch with Google.</p>

<p><em>Now I have a whole new set of complaints&#8230;</em></p>
<p>The way that I finally got accepted was to create an advertisement that linked to one of my <strong>Facebook group pages</strong>.  My idea is to use Facebook to build a list.</p>
<p>And that brings me to my new Facebook complaint:<span id="more-1088"></span></p>
<p><strong>Facebook provides tracking code for tracking your clicks to outside pages, but not for other Facebook pages. </strong></p>
<p>In other words, there&#8217;s no way to track how many people who click through to my group page actually join my group.</p>
<p>I can anecdotally watch my clicks and compare them to how many new members join my group, but I can&#8217;t be sure where the new members are actually coming from&#8230;<strong><em> they could be coming from any one of my pages, an email message, a search engine, etc.</em></strong></p>
<p>There&#8217;s <span style="text-decoration: underline;">no way to track the clicks</span>.</p>
<p>That seems pretty ridiculous since the page is one of Facebook&#8217;s internal pages.  I&#8217;m looking for a way to rig something up, but haven&#8217;t found anything yet (If you have the answer I hope you&#8217;ll tell me!).</p>
<p>Anyway, I&#8217;m planning to add some other ads to see if I can start to figure out what Facebook is looking for in their accepted ads.</p>
<p>The other thing that I wanted to mention today is that <strong>I created another new Hubpage</strong> at:</p>

<p>I&#8217;ve been steadily creating new hubs for the last couple of weeks <strong>to see if they can bring in a significant amount of traffic</strong>.  So far I&#8217;ve been getting <span style="text-decoration: underline;">mixed results</span>, but I&#8217;ll keep reporting on it and let you know how it goes.

<p style="text-align: left;">In fairness, this was really my first time trying to run ads in Facebook, but I couldn&#8217;t help noticing that &#8220;big name&#8221; players like Amazon and Google didn&#8217;t seem to have any problem running all kinds of ads that seemed to violate Facebook&#8217;s terms.</p>
<p style="text-align: left;">There were also several other ads that I see running in the make money/mlm niche that are much worse than anything that I tried to post too.</p>
<p style="text-align: left;">Maybe it just depends on who actually gets assigned to manage your account over at Facebook&#8230; I don&#8217;t know, but this kind of inconsistency totally ticks me off!</p>
